One thing that set America apart from other countries was our legal system. We were known as a land of laws with a fair judicial system. That has changed and eroded to a point that can no longer be sustained. It’s time for oversight, our justice system can no longer be self-regulated.

Our judicial system was the model of the world in which the accused was presumed innocent. The burden of proof falls upon the government to prove its case against the accused.

Lady Justice is our symbol of the judicial system showing a balanced scale and a blindfold to depict impartiality. Through the discovery process, evidence and testimony are shared with both sides. The judge is merely the umpire of the proceedings ensuring that the trial follows the law. The accused has the right to be judged by a group of peers rather than a judge.

What Went Wrong?

What happened, where did it fall apart? Politics entered the scene, and it became a quid pro quo. In order to get elected, Judges and District Attorneys began to sway their decisions. Obviously, it was illegal, but they have what’s known as judicial and prosecutorial discretion.

Prosecutorial discretion was meant to lower sentences for first-time offenders and cut down on caseloads by pleading out. Now it’s being used by the progressive left as a tool of equity for some and a weapon against their opponents.

Violent offenders with multiple prior convictions are being released with downgraded charges because of their minority status. Most repeat their crimes or increase their crimes because there is no penalty against them. The Democrats call it justice reform, law-abiding citizens call it anarchy.

This has become commonplace in Democrat-run cities with a devastating toll on the communities. Crime is rampant as the criminals know if they are caught, they will only get a slap on the wrist. Murders, rapes, robberies, and assaults have doubled and tripled in Democrat communities using the justice reform model.

The Federal Court system has many courts, from Bankruptcy Courts, Article I Courts, District Courts, Circuit Courts, FISA Court, and finally the Supreme Court. The Federal Courts have almost 1800 judges, about half are nominated by sitting Presidents and have lifelong terms. The other half are selected by existing Federal Judges for predetermined terms.

Politics once again rears its ugly head with Federal Judges. Nominations and appointments seem to follow the party in power. Rule of Law and strict adherence to the Constitution are no longer the Progressive Lefts’ criteria.

Where We Are Now

Today the liberal courts are about equity and using the judicial system to allow their friends to get away with illegal actions and hurting their opponents.

Hillary Clinton broke multiple federal crimes and violated national security laws by having a personal computer server with government data on it. The data on the server was then destroyed to cover up the criminal behavior. No charges were filed due to Jim Comey at the FBI being a political ally.

Who Oversees the Legal System?

Believe it or not, the legal system is self-regulating. That’s right, the safety mechanisms are their fellow judges and attorneys. According to the U.S. Courts Administrative Oversight and Accountability page:

Accountability is a core value of the federal Judiciary, as stated in the Strategic Plan for the Federal Judiciary,  encompassing:

• stringent standards of conduct;
• self-enforcement of legal and ethical rules;

The government doesn’t trust you and me to remit taxes without proving in a tax return that it is the correct amount, but we should trust them! There is no real oversight, there is only one course of action that can be taken against a Federal District Attorney or Judge, and that is to be impeached by the House and tried in the Senate. Very few times has that happened.

Most litigants spend millions of dollars in legal fees by the time the Supreme Court renders a decision. The cost to taxpayers is even higher with security issues, law enforcement, judges, clerks, and building costs.

The 9^th Circuit Court of Appeals is considered the most liberal in the nation but is also the largest with 29 judges. The 9^th Circuit Court still makes up less than 3% of the Federal Judges in the system.

Every time a lower court is overturned a red flag should pop up and question whether or not it’s a pattern.

They Are Taking Away My Vote

When there is Judicial Activism, making up their own law, by deciding a case on social or equity-based reasons, your voting power is rendered invalid. If Judges take it upon themselves not to apply the laws as written by Congress, they usurp the authority of the legislative branch. We elect Legislators to debate, craft, and pass our laws for the will of the people. When Judges don’t follow legislatively enacted laws, they take the people out of the process and violate the Constitution.  Our rights to a representative government and electing lawmakers are being bypassed by Judges every day with no consequence.

The Supreme Court corrected one such instance with its interpretation that Roe v. Wade had no Constitutional protections and returned the matter back to the individual states. In 1973 the Supreme Court ruled that abortion was protected in the Constitution. The Constitution does not address the issue, and there was no federal law protecting it. This Supreme Court made the correct judgment.

The System Is Broken

Now we have a Justice system that is broken. Judges are rendering decisions based on their political ideology rather than the rule of law. District Attorneys and Judges are using the justice system to go after political opponents of their party. They’ve ordered wiretaps to listen to them, had the FBI perform early morning raids. Jailing their associates to intimidate on charges that are later dropped.

Judges aren’t following the rule of law and are instead making their own laws usurping the legislative process. There is no accountability because they are self-regulated and won’t discipline a fellow member of the Bar Association.

Congress has the ability for oversight and the ability to enact legislation to monitor and provide oversight of the Judicial Branch. Congress also holds the power of the purse to defund the Judicial Branch.

Most people in Congress are attorneys, so I believe this to be an uphill battle, but one worth taking on. Our current system is broken, costly, usurps authority, and is very unjust. It’s time for oversight, our justice system can no longer be self-regulated.

Contact every member of Congress you can and let them know how angry you are with the Judicial System. Demand accountability and you’re fed up with your vote being bypassed by activist Judges!
